A Broward county Circuit Court jury rejected a plaintiffs' claim that they
were "partners" with Miami Subs and Sun Cruz Casino founder Gus Boulis.
Kiki and Constantin "Gus" Bartsocas sued Boulis' estate claiming that
they were entitled to $10.5 million plus interest which was half the value of
various businesses and property they claimed to co-own with Boulis. The jury
rejected the claim entirely and instead awarded the plaintiffs $1.2 million for
unjust enrichment for unpaid wages.
Glenn Waldman, who represented the Boulis estate, will challenge the unjust enrichment verdict on
the grounds that Boulis never actually employed the Bartsocas' and thus his
estate can't be responsible to pay the debt. Additionally, the claim for unjust
enrichment was not brought within two years of the occurrence as required by
law.
Another lawsuit is still pending in Broward Probate court where the Boulis
estate is attempting to recover a $500,000 loan from the Bartcosas' in 1998 which has never been
repaid.
